How much is the overstay fine in Georgia, and how is it enforced?
The rates are set by Article 191 of the Administrative Offences Code of Georgia and depend solely on the length of the overstay.
| Overstay from the day the lawful stay expired | Fine | Entry ban |
|---|---|---|
| up to 3 months | GEL 1,000 | 6 months |
| up to 1 year | GEL 2,000 | 2 years |
| over 1 year | GEL 3,000 | 3 years |
| breach of transit rules | GEL 500 | — |
There is a separate rate for the host side: inviting an alien, providing them with services, or using their services in breach of the rules for obtaining the right to live, work and study — a warning or GEL 2,000 (Article 191(5)).
Who imposes it, and within what period
Cases under Article 191 are heard by agencies of internal affairs (Article 209(1) of the Code) — no court is involved. The penalty may be imposed no later than 3 months after the offence is identified if it is a continuing one (Article 38(1) of the Code). An overstay is continuing: the clock runs from the day it was detected, not from the day your permitted stay ran out.
Deadlines you should not miss
30 days to pay — from the day a copy of the order imposing the fine is served on you (Article 290(1) of the Code). The "fine at the scene" route with a penalty charge notice does not apply to Article 191: Articles 209(2) and (2¹), which list the offences eligible for it, do not name Article 191 — an order is issued instead.
10 days to appeal — from the day the order is delivered (Article 273(1) of the Code). If the deadline is missed for good reasons, it may be reactivated by the body hearing the appeal upon your application. An agency's order is appealed to a superior agency, whose decision is then appealed to the court (Article 272(1)(a)).
An appeal suspends the running of the 30-day payment period, until you are served with notice that the appeal has been left without consideration (Article 290(1)).
If you do not pay
Two independent consequences.
First, enforced collection: from wages, pension, scholarship or other income, and where that is impossible, by levying execution on personal property or a share in common property through an enforcement officer (Article 291(1) and (2) of the Code).
Second — and for most people this weighs more: until the fine is paid you will not be granted a visa and will be refused entry. Both the Note to Article 191 of the Code (the Ministry of Foreign Affairs and the Ministry of Internal Affairs are notified of non-payment) and Article 47(4) of the Law on Aliens say so directly. Article 11(1)(b) and (b¹) makes an unpaid fine a self-standing ground for refusing entry.
How and when to pay
Article 47(4) allows the fine to be paid either before leaving Georgia or after — the obligation is not tied to the moment of crossing the border. The amount is paid into a bank for transfer to the state budget; the payment must state the first name, surname and personal number, together with the number, date and series of the act imposing the penalty (Article 290(3) of the Code).
In practice, an overstay fine is most often processed on exit, at passport control: at airports, at the border police desk; at land crossings (Sarpi, Sadakhlo, Verkhny Lars and others), in a room next to the control point. Allow time for it: at a land border the paperwork can take considerably longer than passport control itself, and payment facilities differ from crossing to crossing.
When no fine arises
Article 47(5) of the Law on Aliens: no administrative penalty in the form of a fine is imposed if you left Georgia within 30 calendar days of the relevant decision of an authorised body and, in addition, your Georgian citizenship was terminated; your application for stateless status or international protection was refused; your residence permit was terminated on the grounds in Article 21(1)(b)–(d); or your probation period expired under a conditional sentence, or you served your sentence.
This is a closed list. An ordinary tourist overstay is not on it.
